The Council of the City of Eddyville met in special session on January
2, 2007 at 7:00 p.m. in City Hall, Mayor Johnston presiding.
Council Members present: John R. Johnson, Jim Durst, Larry Harding,
Dwight Lobberecht.
Council Members absent: Lance Johnston.
Durst moved seconded by Harding to approve the agenda as presented. AYE:
4. NAY: 0. Motion carried.
Harding moved, seconded by Johnson to approve minutes of meeting in
December and paying bills for December payable in January with the
addition of utility bills that had not come in yet. AYE: 4. NAY: 0.
Motion carried.
Harding moved, seconded by Durst to approve liquor and Sunday Sales for
Ford’s Pub and Grill, subject to insurance coming in. AYE: 4. NAY: 0.
Motion carried.
Lobberecht introduced Resolution 2007-01-001 and moved its adoption, a
resolution to approve the STP grant application and authorize the Mayor
to sign the application, seconded by Harding. AYE: Durst, Harding,
Lobberecht, Johnson. NAY: 0. Resolution passed.
Lobberecht moved, seconded by Harding to go into closed session at 7:10
p.m., under Chapter 21.5© to discuss strategy with counsel matters that
are presently in litigation or where litigation is imminent where its
disclosure would be likely to prejudice or disadvantage the position of
the governmental body in that litigation. AYE: Harding, Lobberecht,
Johnson, Durst. NAY: 0. Motion carried.
Johnson moved, seconded by Durst to come out of closed session at 7:30
p.m. AYE: Lobberecht, Johnson, Durst, Harding. NAY: 0. Motion carried.
Johnson moved, seconded by Lobberecht to have attorney check into closed
session items further before any legal actions occurs. AYE: 4. NAY: 0.
Motion carried.
Lobberecht introduced Resolution 2007-01-002 and moved its adoption, a
resolution approving tax abatement for James and Kimberly Koellner at
505 N. 8th St. seconded by Harding. AYE: Durst, Harding, Lobberecht,
Johnson. NAY: 0. Resolution passed.
Johnson introduced Resolution 2007-01-003 and moved its adoption, a
resolution approving the Mediacom Franchise Agreement for five years,
seconded by Durst. AYE: Harding, Lobberecht, Johnson, Durst. NAY: 0.
Resolution passed.
Fire Chief Smith reported 1 medical assist and 1 car wreck.
Lobberecht moved, seconded by Johnson to approve the appointment of Gene
Rouze to the Mahaska County Emergency Management Agency. AYE: 4. NAY: 0.
Motion carried.
Clerk to send a letter to 305 N. Merino Ave informing the owner that
they need a permit to put a driveway and tube in, and the driveway and
tube they put in was installed incorrectly.
After some discussion Harding moved, seconded by Durst to pay the annual
fee for MCARD and to appoint council member Harding to be the
representative for the city. AYE: 4. NAY: 0. Motion carried.
