The Council of the City of Eddyville met in regular session on Monday, October 4, 2010 at 7:00 p.m. in City Hall, Mayor Johnston presiding.
Council members present: Doug Greenlee, John Simmers, Jim Durst, Wendell Terrell, Dwight Lobberecht.
Council members absent: None.
The Mayor announced this to be the time and place set for the second public hearing on amending Ordinance 96 “BUILDING SEWER AND CONNECTIONS” by adding the following 96.04(14) “new construction will need to add a sewer backflow preventer not less than 4” to prevent sewage from backing up into the basement. After a discussion on whether this was for a basement or any structure Greenlee moved, seconded by Terrell to close the hearing at 7:11 p. m. AYE: 5. NAY: 0. Motion carried.
Durst moved, seconded by Terrell to approve agenda as presented. AYE: 5. NAY: 0. Motion carried.
Simmers moved, seconded by Greenlee to approve the consent agenda consisting of minutes of meeting in September and bills for September payable in October 2010. AYE: 5. NAY: 0. Motion carried.
Greenlee moved, seconded by Durst to delete the word basement and add all new sewer hook ups will need a backflow preventer. AYE: 4. NAY: Lobberecht. Motion carried.
Terrell moved, seconded by Simmers to table any further action of the backflow preventer until the attorney looks at the wording for a public hearing. AYE: 5. NAY: 0. Motion carried.
Mr. Welsch had questions about the storm sewer work and grant the Mayor told him it was still with the engineers and had not gone to bid yet, and the cemetery hill was still being cleaned up.
Terrell moved, seconded by Durst to approve a cigarette permit for Eddyville Market and Deli. AYE: 5. NAY: 0. Motion carried.
Simmers moved, seconded by Terrell to approve a beer, wine and liquor permit for Eddyville Market & Deli. AYE: 5. NAY: 0. Motion carried.
Terrell moved, seconded by Durst to approve a contract for archeological services for 2009 Storm and Sanitary Sewer CDBG as presented by AREA 15. AYE: 5. NAY: 0. Motion carried.
Greenlee introduced Resolution 2010-29 and moved its adoption, a resolution to adopt the Record Retention and Disposition Schedule as provided by the Iowa Municipal Finance Officers Association, seconded by Simmers. AYE: Simmers, Durst, Terrell, Lobberecht, Greenlee. NAY: 0. Resolution passed.
The Mayor announced Trick or Treat night for Saturday, October 30, 2010 from 6-8:00 p.m.
Simmers moved, seconded by Greenlee to proceed with volunteer annexing property at 701 N. Merino Ave. now owned by Dwight Lobberecht into city limits. AYE: 4. NAY: 0. ABSTAIN: Lobberecht.
